Right to a Written Rent Agreement
Under Indian property law, every tenant is entitled to a formal, written Leave and License or Rental Agreement. This document must explicitly state the monthly rent, security deposit, annual escalation clause (typically 5-10%), lock-in period, and notice period. Never rely on verbal commitments or WhatsApp messages as primary binding agreements.
Right to Valid Payment Receipts
You have an absolute fundamental right to demand a formal receipt for every transaction—be it the booking token, security deposit, or monthly rent. While digital records (UPI/Bank Transfers) serve as valid legal proof of transaction, a formal receipt from the landlord acknowledging what the payment was for ensures zero ambiguity.
Protection Against Unlawful Eviction
A landlord cannot arbitrarily evict you overnight. Standard legal eviction requires a formal written notice (typically 30 to 60 days as per your agreement) unless you have severely violated the lease terms (e.g., illegal activities, severe property destruction). 'Immediate eviction' without cause or due process is illegal under the Rent Control Act.
Right to Exclusive Privacy
Once you rent a property, you possess the right to 'quiet enjoyment'. The landlord cannot enter your rented premises unannounced or without your explicit permission, except in absolute emergencies (like a burst pipe or fire). Standard practice requires at least 24 hours of prior notice for routine inspections or maintenance.
Security Deposit Protection
By law, the security deposit is your money held in trust by the landlord. It must be refunded in full when you vacate the premises, barring valid, documented deductions for unpaid utility bills or structural damages beyond 'normal wear and tear'. Landlords cannot legally deduct money for natural aging of the property (like faded paint or minor scuffs).
Right to Essential Services
A landlord cannot arbitrarily cut off essential services (electricity, water, sanitation) to force an eviction or settle a dispute. Withholding these fundamental human necessities is considered an illegal act of coercion.
Right to Property Maintenance
While tenants are responsible for minor day-to-day upkeep (like changing a light bulb), the landlord is legally obligated to maintain the structural integrity of the property. Right to Clear Terms Before Holding Tokens
