1. Acceptance of Terms

By accessing, browsing, or using the Assam Home Rentals platform, mobile application, or any associated services (collectively, "the Service"), you are agreeing to these Terms of Service, along with our Privacy Policy and any other agreements referenced herein. If you do not agree to all of these Terms, you are expressly prohibited from using the Service and must discontinue use immediately.

2. Definitions

• "Platform" refers to the Assam Home Rentals website, encompassing all domains, subdomains, and applications.
• "User", "You", or "Your" refers to any individual or entity utilizing our Platform.
• "Owner" or "Landlord" refers to users listing their properties for rent.
• "Tenant" refers to users searching for or securing rental properties.
• "Listing" refers to properties published by Owners on the Platform.

3. Eligibility and Account Registration

You must be at least 18 years of age and legally capable of entering into binding contracts under Indian law to use our Platform. By registering an account, you represent and warrant that:

• All registration information you submit is true, accurate, current, and complete.
• You will maintain the accuracy of such information and promptly update such registration information as necessary.
• You will keep your password confidential and will be responsible for all use of your password and account.
• You are not a person barred from receiving services under the laws of India or other applicable jurisdictions.

4. Platform Role and Limitations

Assam Home Rentals serves exclusively as a digital intermediary platform connecting independent property Owners with potential Tenants. We are not a real estate broker, agent, or property manager.

• We do not own, sell, rent, manage, or control the properties listed on the Platform.
• We are not a party to any lease, rental agreement, or other transaction between Owners and Tenants.
• We do not guarantee the condition, legality, safety, or suitability of properties.
• We do not guarantee the payment of rent or the performance of any obligations by Users.

5. Property Listing Rules (For Owners)

When creating a property Listing as an Owner, you agree to adhere to the following directives:

• Accuracy: All details, including pricing, dimensions, amenities, and photographs, must accurately reflect the real state of the property.
• Authority: You represent that you are the legal owner or have lawful authority to rent the property.
• Compliance: Your property must comply with all local housing, zoning, and safety regulations across Assam and India.
• Non-Discrimination: You agree not to discriminate against any potential Tenant based on race, religion, caste, gender, marital status, or dietary preferences.

6. Prohibited Activities

Users agree not to engage in any of the following restricted activities:

• Posting false, misleading, or deceptive Listings or information.
• Using the Platform for money laundering, fraud, or any illegal purposes.
• Attempting to bypass platform protocols, data scraping, or deploying malicious software.
• Harassing, threatening, or defrauding other Users.
• Demanding unreasonable or illegal deposits, convenience fees, or arbitrary charges outside of standard rental norms.

7. Intellectual Property

All content on the Assam Home Rentals Platform, including text, graphics, logos, images, software, and the compilation thereof, is our property or the property of our licensors and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive license to use the Platform for your personal, non-commercial use.

8. Limitation of Liability

To the maximum extent permitted by applicable Indian law, Assam Home Rentals, its directors, employees, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from:

• Any errors, mistakes, or inaccuracies of content or Listings.
• Personal injury or property damage resulting from your access to or use of our Platform or the properties listed therein.
• Any unauthorized access to or use of our secure servers and any personal data stored therein.
• Any disputes, financial losses, or physical harm arising directly or indirectly out of interactions between Owners and Tenants.

9. Indemnification

You agree to defend, indemnify, and hold harmless Assam Home Rentals, its affiliates, and their respective officers, directors, and employees, from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms of Service or your use of the Platform.

10. Termination of Service

We reserve the right, in our sole discretion, to restrict, suspend, or terminate your access to all or any part of the Platform at any time, for any or no reason, with or without prior notice, and without liability. If we believe a User is involved in fraudulent activity, their account will be permanently banned and reported to relevant authorities.

11. Governing Law and Dispute Resolution

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of India. Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be subject to the exclusive jurisdiction of the competent courts situated in Guwahati, Assam.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify Users of any material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Platform after such modifications constitutes your acknowledgment of the modified Terms and agreement to abide by them.
